Retail Terms and Conditions

These Terms of Sale apply to all sales of household appliances for domestic and non-commercial use in Canada concluded between you and Aroua Tek Inc. (hereinafter, “Aroua Tek Inc.”). You accept these terms when you purchase one of these household appliances.
  1. Definitions
  2. 1 In this Agreement, the following terms and expressions shall have the following meanings.
  3. (a) “Consumer Proposal” means a valid proposal provided to you by Aroua Tek Inc. or one of its authorized representatives or stored in Aroua Tek Inc.’s database.
  4. (b) “You” means the purchaser of the Product, yourself, as named on the Consumer Proposal or on the Order Confirmation under the heading “Consumer Billing Information”.
  5. (c) “Order Confirmation” means (i) your acceptance of your purchase order, or (ii) your acknowledgement of the proposal made by you to Aroua Tek Inc. in writing, in digital or physical form.
  6. Agreement
  7. 1 An agreement is concluded between you and Aroua Tek Inc. regarding the purchase of the product if and when Aroua Tek Inc. accepts your order by issuing an order confirmation. The order confirmation will be considered issued if it is stored and accessible by Aroua Tek Inc. in its database, whether given or shown to you in electronic or physical form. Upon issuance of the order confirmation, ownership of the products is transferred to you.
  8. Proposal, price and characteristics
  9. 1 A proposal to a consumer is valid for a maximum period of 90 days from the date it is issued. If
  10. (a) a product or
  11. (b) the price given for a product
  12. In a consumer proposal is the subject of a promotion of any kind, the consumer proposal concerning this product or this price is valid either for 30 days from the date it is issued, or until the expiry of the applicable promotion, whichever comes first. Changes made to provincial and federal taxes that apply to the purchase of Aroua Tek inc. products are not affected by the 30-day validity period.
  13. 2 The price payable is the price appearing on the order confirmation. In the event of a discrepancy between the order confirmation given or shown to you and the one stored in the Aroua Tek inc. database, the latter shall prevail.
  14. 3 Unless otherwise expressly agreed in writing by Aroua Tek Inc., the figures, measurements, dimensions, performance values, dollar values, samples, patterns, statements, technical provisions or characteristics, catalogues, brochures, descriptions, photographs, models, designs, drawings, promotional materials in printed or electronic form or other descriptive characteristics concerning the consumer proposal (hereinafter, the “promotional characteristics”) are only approximations and shall not form part of this agreement or any other agreement, nor be interpreted as representations, warranties or conditions in relation to the products unless confirmed in the order confirmation. Aroua Tek Inc. reserves the right to modify or change the promotional characteristics at any time and without notice before the order confirmation is issued.
  15. Payment
  16. 1 Unless otherwise stipulated by Aroua Tek Inc. The full purchase price is due and payable at the time of placing the order, except where the requested delivery date is tentative. In such case, a 25% deposit is due and payable at the time of placing the order, and the balance will be due and payable at least three (3) days prior to the confirmed delivery date.
  17. 2 If Products listed in the same Order Confirmation are to be delivered at different times, payment for each such Product is due in accordance with these provisions as if each Product were ordered separately.
  18. 3 In addition to the purchase price payable for the Products, you agree to pay all applicable goods and services tax, harmonized sales tax, sales tax (including provincial sales taxes), or any other taxes payable on the purchase of the Products. If you are purchasing products on a fully installed basis in the Province of British Columbia, you agree to be responsible for British Columbia provincial sales tax pursuant to Section 80 of the Provincial Sales Tax Act on the purchase price of the products installed in British Columbia.
  19. The 25% deposit must be paid at the point of sale using an American Express, Visa or MasterCard credit card. All sales must be paid in advance of delivery. The sale may be paid using an American Express, Visa or MasterCard credit card or by electronic invoice payment when the total order value before taxes is less than $5,000. For orders with a total order value before taxes of $5,000 or more, the sale may only be paid by electronic invoice payment.
  1. Default in Payment
  2. 1 If you fail to make a payment to Aroua Tek Inc. when it is due, you will, subject to any other right or remedy of Aroua Tek Inc.:
  3. (a) an administrative fee on the unpaid amount of 5% of the total invoice amount, plus interest compounded daily at an annual rate equal to the rate of Aroua Tek Inc.’s bank in Quebec, at the prime rate, plus 4%;
  4. (b) reimburse Aroua Tek Inc. for all reasonable costs and expenses incurred by Aroua Tek Inc. in connection with the unpaid debt and the collection of such debt;
  5. (c) upon reasonable notice from Aroua Tek Inc. and at its discretion, return the affected product to Aroua Tek Inc. or allow a representative of Aroua Tek Inc. reasonable access to said product in order to repossess it.
  6. Delivery
  7. 1 Aroua Tek Inc. will deliver your order to the location specified on the order confirmation.
  8. 2 If Aroua Tek Inc. fails to deliver the product within 30 days of the scheduled date due to a cause reasonably within its control, you may terminate this Agreement by giving five (5) business days’ notice. If the product is not delivered within the notice period, this Agreement is terminated.
  9. 3 If a particular product model is no longer sold or is replaced and cannot be delivered on the scheduled date, Aroua Tek Inc. will inform you before said date that:
  10. (a) at the discretion of Aroua Tek Inc. an equivalent or superior model is available and is offered to you as a replacement at a reasonable additional charge; or
  11. (b) the model ordered is not available and this Agreement is terminated.
  12. 4 Your acceptance of an equivalent or superior model in accordance with paragraph 6.3 (a) will modify the order confirmation accordingly. Failure to accept an offer of an equivalent or superior product within five (5) business days will terminate this Agreement with respect to the product in question.
  13. 5 If you refuse to accept delivery of a product, Aroua Tek Inc. may terminate this Agreement by giving five (5) business days’ notice. If you fail to take delivery of the product from Aroua Tek Inc. or if you refuse to pay the additional delivery charges and accept delivery of the product during the notice period, this agreement is terminated.
  14. 6 If delivery of the product is not made, without any fault on the part of Aroua Tek Inc. within six (6) months from the required delivery date, this agreement is terminated, as is your order excluding the deposit.
  15. Return or exchange of products
  16. 1 Products delivered to you may be returned to or exchanged by Aroua Tek Inc. Only as provided in this Article.
  17. 2  Requests for returns or exchanges due to cosmetic damage, manufacturing or design defects or due to improper installation (assuming that said installation was carried out by Aroua Tek Inc. or its authorized representatives) are subject to the standard warranty of Aroua Tek Inc. and the products may not be returned or exchanged, except as provided herein. The standard warranty of Aroua Tek Inc. is attached hereto or, failing that, accessible at www.arouatek.ca.
  18. 3  Requests for returns or exchanges for any other reason, including in the event of dissatisfaction with the product, an unsuitable product or defects not covered by the standard warranty of Aroua Tek Inc. are accepted at the sole discretion of the latter. If a return or exchange is accepted, an Aroua Tek Inc. customer service representative will contact you to arrange the return. If a return or exchange is made, you will be required to pay return shipping costs and, at Aroua Tek Inc.’s discretion, the cost of labor, transportation and parts. If the product has not been removed from its original packaging, return shipping costs will not exceed 10% of the MSRP. In other cases, return shipping costs will not exceed 25% of the MSRP.
  19. Refund in the event of cancellation of delivery
  20. 1 If this Agreement, in respect of any product ordered, is terminated prior to delivery:
  21. (a) for a reason directly attributable to Aroua Tek Inc., including termination under clauses 6.2, 6.3 (b) or 6.4; or
  22. (b) before the earliest of the following: (i) 24 hours after the order has been placed; (ii) the time when the Aroua Tek Inc. customer service center confirms the order to you by telephone;
  23. Aroua Tek Inc. will refund the full amount you have paid for said product. Aroua Tek Inc. will not, however, assume any liability for interest, losses or damages arising from termination.
  24. 2 If this Agreement, in relation to a product ordered, is modified, cancelled or terminated prior to delivery for any reason whatsoever, you must pay Aroua Tek, or Aroua Tek Inc. will deduct from any deposits you have made, an administration fee of 10% of the deposit made by you or the minimum deposit due for such product and Aroua Tek Inc. will return to you any balance of the amounts deposited after the administration fee has been deducted.
  25. 3 Notwithstanding clauses 8.1 and 8.2, if you terminate this Agreement in respect of a Product to be designed or manufactured to your specifications, Aroua Tek Inc. will retain all amounts paid by you.
  26. Ownership and Risk
  27. 1 You grant Aroua Tek Inc. a security interest in any Product purchased until all amounts, including additional amounts due under this Agreement or any renewal or extension of this Agreement, or under a judgment obtained in connection with Aroua Tek Inc.’s rights, have been paid. hereunder, are fully discharged.
  28. 2 You agree not to sell, encumber or otherwise deal with the product to a third party until the price itself has been fully paid to Aroua Tek. If you intend to do so, you must hold the proceeds of the sale or other transaction in trust for Aroua Tek Inc. up to the maximum of the balance due.
  29. 3 Notwithstanding clauses 9.1 and 9.2, the risk of loss or damage to the products passes to you from the time of delivery.
  30. Warranty
  31. 1 The warranties offered on Aroua Tek Inc. devices purchased by you are the warranties inc. (i) contained in the current Aroua Tek Inc. warranty attached hereto or, failing that, accessible at www.arouatek.ca and (ii) contained in the extended warranty of Aroua Tek Inc. if you purchased this warranty for an additional fee, Aroua Tek Inc. reserves the right to modify the terms of either warranty at any time and without notice. You will find a copy of the extended warranty of Aroua Tek Inc. at www.arouatek.ca.
  32. 2 THE EXPRESS WARRANTIES CONTAINED HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
  33. Confidentiality
  34. 1 Aroua Tek Inc. will collect, use and disclose your personal information (including your name and home address and telephone number) only in accordance with Aroua Tek Inc.’s Privacy Policy. accessible at www.Arouatek.ca, and in accordance with the confidentiality principles in force in Canada.
  35. Limitation of liability
  36. 1 AROUA TEK, ITS AFFILIATES, THEIR OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, ASSUME NO LIABILITY OTHER THAN THE REMEDIES PROVIDED HEREIN. IN ALL CIRCUMSTANCES, AROUA TEK INC.’S LIABILITY WILL NOT EXCEED (i) THE PRICE PAID FOR THE PRODUCT AND (ii) THE COST OF REPAIR OR
  37. REPLACEMENT (AT AROUA TEK Inc.’S DISCRETION) OF THE PRODUCT (OR THE DEFECTIVE PART OF THE PRODUCT). AROUA TEK Inc. ASSUMES NO LIABILITY (AND YOU AGREE TO RELEASE AROUA TEK INC. FROM ANY LIABILITY) FOR ANY BODILY INJURY OR PROPERTY DAMAGE SUFFERED BY YOU OR ANY OTHER PERSON, RESULTING FROM THE HANDLING, POSSESSION, USE OR SALE OF ANY PRODUCT PURCHASED BY YOU. AROUA TEK inc. ASSUMES NO LIABILITY WHATSOEVER ARISING FROM ANY CLAIMS BY THIRD PARTIES, INCLUDING BUYERS AND END USERS IN THE EVENT OF RESALE. AROUA TEK inc. ASSUMES NO LIABILITY FOR LOSS OF PROFITS OR GOODWILL OR OTHER INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, EVEN IF AROUA TEK Inc. HAS BEEN ADVISED OF THE RISK OF SUCH DAMAGES, OR FOR ANY CLAIM BY A THIRD PARTY, EXCEPT AS EXPRESSLY PROVIDED HEREIN.
  38. Applicable Law
  39. 1 This Service Agreement shall be governed by and construed in accordance with the laws of the Province of Quebec and those of Canada, which are applicable for the purposes hereof, excluding their conflict of laws rules. Both parties hereby explicitly and irrevocably acknowledge the exclusive jurisdiction of the courts sitting in Quebec, or the courts of any other jurisdiction where Aroua Tek Inc. may assert its rights.
  40. Miscellaneous
  41. 1 You may also have other rights under consumer protection laws that may differ from one Canadian province to another. Some provinces do not allow limitations and exclusions of implied warranties; it is therefore possible that certain limitations and exclusions do not apply.
  42. 2  This agreement applies to the benefit and to the charge of each of the respective heirs and assigns of the parties, provided that you refrain from assigning or transferring your rights and obligations under this agreement unless you have obtained in writing the prior consent of Aroua Tek.
  43. 3  If any provision of this agreement is found to be invalid or unenforceable in a jurisdiction of judicial jurisdiction (i) the other provisions of this agreement to the fullest extent permitted by law remain fully enforceable in said jurisdictions and must be liberally interpreted in favor of Aroua Tek inc. in order to give effect to the intent of the parties hereto to the greatest extent possible; and (ii) the invalidity or unenforceability of any provision hereof in one jurisdiction shall not affect the validity and enforceability of such provision in any other jurisdiction.
  44. 4 In any action taken to enforce its rights under this Agreement, Aroua Tek Inc. is entitled to reasonable legal fees, in addition to any other remedies.
  45. 5 The headings in this document are used for convenience only and do not affect the meaning of the document.
  46. Website
  47. 1 Aroua Tek Inc. does not guarantee that the information presented on the Website is current, up-to-date or accurate and assumes no responsibility for any financial loss that may arise from the use of the Website. Any risk as to the quality, accuracy, completeness, correctness and validity of the data shall be assumed by the customer.
  48. AROUA TEK Inc. WARRANTY
  49. The following warranty conditions are valid in Canada only.
  50. Aroua Tek Inc. (hereinafter, “Aroua Tek Inc.”) warrants to the original purchaser that this product, including all of its parts and accessories authorized by Aroua Tek Inc., is free from manufacturing defects (materials and workmanship).
  51. Warranty Duration
  52. This warranty is valid for the periods set forth below.
  53. (a) Household appliances used in a normal, domestic and non-commercial context:
  54. (i) Three (3) years. Parts and labor including travel.
  55. (ii) Five (5) years. Parts and labor in the case of an installation done directly by Aroua Tek Inc. or one of its duly authorized partners. Travel costs to be expected beyond the basic 3-year warranty.
  56. (iii) Additional 5 and 10-year warranty per package are added to the basic warranty. Parts and labor excluding any travel costs. If a claim relating to a manufacturing defect (materials or labor) is received by Aroua Tek Inc. within five (5) years or ten (10) years from the date of purchase for any defect, is covered by the warranty and will be repaired at no cost to you (including parts and labor excluding travel).
  57. (v) Ten (10) Year Warranty – If a claim for any of the said defects is received at any time during the period commencing on the first day of the sixth (6th) year and ending on the last day of the tenth year following the date of purchase, this warranty will cover the replacement or repair of all parts under warranty that are defective in workmanship and not covering travel expenses.
  58. (vi) The warranty does not cover any light bulbs, LEDs or mesh filters or baffles.
  59. (b) Domestic appliances used in a commercial environment:
  60. (i) Twelve (12) months parts, six (6) months labor.
  61. Effective Date
  62. The warranty is effective from the date of purchase. If a product under warranty is replaced by Aroua Tek Inc., the warranty continues from the original date of purchase.
  63. Warranty Prerequisites
  64. 1 Aroua Tek Inc. assumes responsibility for the warranty provided that the following prerequisites are met:
  65. (a) you are the first purchaser or you obtained the product through resale, having completed the transfer of ownership form and having paid the warranty transfer fee of $75 plus applicable taxes depending on the established territory.
  66. (b) the product was purchased from Aroua Tek Inc. or an Aroua Tek Inc. dealer. approved in Canada;
  67. (c) where applicable, the product has been installed by a person designated by Aroua Tek Inc. as having the necessary skills and in accordance with the applicable installation instructions;
  68. (d) the product is used in Canada.
  69. 2 Warranty claims will be honored only if a warranty defect is reported in writing and the product, along with proof of the date of purchase, is returned to Aroua Tek Inc. or an authorized Aroua Tek Inc. dealer, as the case may be, within the period stipulated in section 1 above.
  70. Scope of Warranty
  71. In the event that a manufacturing defect (part or workmanship) is discovered during the period stipulated in section 1 above, Aroua Tek Inc. will repair, or, at its option, replace, within a reasonable time, the product or the authorized Aroua Tek Inc. part or accessory exhibiting the manufacturing defect. Defective parts and products become the property of Aroua Tek Inc. in case of replacement.
  72. Exclusions
  73. The warranty does not apply to a product, including its parts and accessories, which:
  74. (a) have not been installed in accordance with Aroua Tek Inc.’s installation instructions.
  75. (b) have been damaged as a result of negligence, accident, abuse or misuse, or incorrect or abnormal use, maintenance or transportation;
  76. (c) contains accessories or replacement parts that are not genuine Aroua Tek accessories or parts, including filters and other products that are not Aroua Tek products;
  77. (d) have been repaired, maintained, changed or modified by a service center or technician not authorized by Aroua Tek Inc.
  78. (e) change of residence, possible exclusion and must be accepted by Arou Tek Inc. thirty (30) days before any change. Uninstallation and reinstallation must be done by Aroua Tek Inc. or one of its authorized partners for the continuation of the warranty.
  79. Normal wear and tear
  80. Normal wear and tear should not be considered a manufacturing defect.
  81. Limitation of liability
  82. 1 Unless you purchase an extended warranty from Aroua Tek Inc. before the expiration of this basic warranty, this warranty is the only warranty offered by Aroua Tek Inc. Aroua Tek Inc. disclaims all other warranties to the fullest extent permitted by law, whether express or implied, including any warranty of merchantability or fitness for a particular purpose, except as provided herein.
  83. 2 Your sole remedies under this warranty are those described herein. Unless otherwise specified, Aroua Tek Inc.’s liability for actual damage, however caused, is limited to the amount you paid for the product. Aroua Tek Inc. disclaims all liability and any consequential or other damages whether based on breach of contract, tort (including negligence), product liability or any other legal theory. In no event shall the parties be liable for lost profits or savings, incidental damages or other economic damages.
  84. Specific Provincial Laws
  85. This warranty gives the purchaser specific legal rights. The purchaser may also have other rights that may vary from one Canadian province to another. Some provinces do not allow limitations and exclusions of implied warranties, so the above limitations and exclusions may not apply to you. therefore, certain limitations and exclusions may not apply.

  1. 2 Service may require that the device be removed and transported by authorized Aroua Tek Inc. personnel to an Aroua Tek Inc.-approved service center. If the service is requested by you in a remote geographic area, as determined by Aroua Tek Inc. in its sole discretion, you will be responsible for the costs in one of the following two ways, at the discretion of Aroua Tek Inc.:
  2. (a) travel costs incurred by Aroua Tek Inc. to travel to your premises;
  3. (b) cost of removing the device from your premises and shipping it to the Aroua Tek Inc. authorized service center. nearest.

  1. AROUA TEK EXTENDED WARRANTY
  2. Validity
  3. 1 The terms of this extended warranty from Aroua Tek inc. (hereinafter, “Aroua Tek inc.”) apply only to non-commercial household appliances for domestic use purchased directly from Aroua Tek inc. (including devices whose purchase was facilitated by authorized representatives) or from authorized Aroua Tek Inc. dealers, by the original consumer purchaser (hereinafter, “you”, “your”), under the following conditions:
  4. (a) you purchased the device from an authorized Aroua Tek Inc. dealer, you purchased the extended warranty from said dealer and paid for it in full at the time you purchased the device; or
  5. (b) you purchased the extended warranty directly from Aroua Tek Inc. and paid for it in full within the validity period of Aroua Tek’s current warranty; Aroua Tek Inc. has agreed that said device is protected by the extended warranty. The extended warranty is valid in Canada only.

  1. 2 Service may require that the unit be removed and transported by authorized Aroua Tek Inc. personnel to an Aroua Tek Inc.-approved service center. If service is requested by you in a remote area, as determined by Aroua Tek Inc. in its sole discretion, you must assume responsibility for the costs according to one of the two options below, at Aroua Tek Inc.’s discretion:
  2. (a) travel costs incurred by Aroua Tek Inc. to travel to your premises; or
  3. (b) cost of removing the device from your premises and shipping it to the nearest Aroua Tek Inc. authorized service center.
  4. Exclusions
  5. 1 The coverage explicitly excludes the repair and maintenance of the following:
  6. (a) devices that are not purchased from Aroua Tek Inc. or an authorized representative of Aroua Tek, resold devices and all other devices that are no longer the property of the original purchaser;
  7. (b) additional options or accessories to the device;
  8. (c) broken glass or light bulbs;
  9. (d) normal wear and tear, including rust, scratches and marks;
  10. (e) cosmetic damage, including noise, that does not affect the operation of the device.
  11. 2 The service does not include repairs that are due to neglect or abuse, accident, repair, modification or change made by a supplier other than those explicitly approved by Aroua Tek, the customer’s failure to perform recommended maintenance or comply with Aroua Tek’s operating instructions, parts other than Aroua Tek Inc. parts. and other causes, whether internal or external to the device, and which are beyond the control of Aroua Tek Inc. Aroua Tek Inc. does not guarantee that the device will operate without interruption or without defects.
  12. Replacement parts
  13. All parts used during repairs will be provided on an exchange basis. All parts provided will be new parts or the equivalent. All parts removed or replaced become the property of Aroua Tek Inc.
  14. Limitation of liability
  15. 1 The Inc. warranty and this extended warranty are the only warranties offered to you by Aroua Tek Inc. Aroua Tek Inc. disclaims all other warranties to the fullest extent permitted by law, whether express or implied, including any warranty of merchantability or fitness for a particular purpose, except as provided herein.
  16. 2 Your sole remedies under this extended warranty are those described herein. Unless otherwise specified, Aroua Tek Inc.’s liability for actual damages, however caused, is limited to the amount you paid for the device. Aroua Tek Inc. disclaims all liability and any consequential or other damages whether based on breach of contract, tort (including negligence), product liability or any other legal theory. In no event shall the parties be liable for lost profits or savings, incidental damages or other economic damages.
  17. Cancellation
  18. The extended warranty only comes into effect when Aroua Tek Inc. receives full payment. When payment is made to an authorized representative of Aroua Tek Inc., the warranty only comes into effect when Aroua Tek Inc. receives payment from said representative. Either party may terminate this extended warranty at any time upon three months’ notice. If the extended warranty is cancelled, Aroua Tek Inc. will refund the remaining portion of the price on a pro rata basis, less a $25 administration fee.
  19. Specific provincial laws
  20. This warranty gives you specific legal rights. You may also have other rights that vary from one Canadian province to another. Some provinces do not allow the limitation or exclusion of implied warranties or liabilities. Therefore, some limitations and exclusions may not apply.
  21. AROUA TEK DELIVERY POLICY
  22. Warehousing and Inventory
  23. 1 Aroua Tek Inc. will provide warehousing facilities through its network in major metropolitan areas across Canada to facilitate direct delivery to the consumer’s home when economically feasible. Aroua Tek Inc. will endeavour to stock sufficient 30 and 36 inch standard products excluding any customization to reduce recall orders.
  24. Home Delivery Service
  25. 1 If your home or premises, as specified on the Order Confirmation, are located in a major metropolitan centre, as defined by Aroua Tek Inc. at the time in question, and delivery is deemed cost-effective in the sole discretion of Aroua Tek Inc., Aroua Tek Inc. will deliver and, if applicable, install the product you have ordered, directly to your home or premises from the nearest Aroua Tek Inc. warehouse (hereinafter, the “Home Delivery Service”) or according to the locally authorized partner.
  26. 2 If you are eligible for the Home Delivery Service, Aroua Tek Inc.:
  27. (a) will offer you a choice of two delivery dates. Aroua Tek Inc. will make all reasonable efforts to make delivery on your preferred date. If Aroua Tek Inc. cannot make delivery on your preferred date, Aroua Tek Inc. guarantees delivery on the second date;
  28. (b) will contact you 24 to 48 hours before the scheduled delivery to confirm the delivery address and provide an approximate delivery time. If delivery is delayed by more than two hours from the estimated time, Aroua Tek Inc. will contact you to reschedule a new delivery time or date;
  29. (c) will not make delivery unless a person of the age of majority is present to accept it. If you fail to provide at least 4 hours’ notice that the person will not be present at the requested time, you will be required to pay the amount applicable to the delivery as set out in the order confirmation. In addition, you will be required to pay the same amount for any subsequent deliveries.
  30. (d) ensure that all its delivery and installation personnel are adequately trained and clearly identified as being assigned to the “Aroua Tek Inc. Authorized Delivery Service”. All personnel must provide Aroua Tek Inc. with: a satisfactory criminal record;
  31. (e) will take all reasonable precautions to avoid damaging your property, including requiring that delivery personnel or representatives:
  32. (i) wear protective shoe covers;
  33. (ii) use appropriate delivery equipment;
  34. (iii) use floor coverings and padded blankets;
  35. (iv) take all other measures deemed necessary by Aroua Tek Inc. to reduce the risk of damage to your property or the product.
  36. However, for health and safety reasons, all delivery and installation personnel must wear approved safety footwear at all times;
  37. (f) instruct its delivery personnel to place the product at a location of your choosing, provided that your request is reasonable;
  38. (g) upon request, remove and dispose of all packaging material and inspect the product for damage. If any damage is found during the inspection, the delivery personnel will report it as soon as possible to Aroua Tek Inc. Customer Service. If no damage is found, you will confirm on the delivery receipt that the product was delivered “free of any damage”.
  39. If you do not request that the packaging material be removed and disposed of, Aroua Tek Inc. recommends that the packaging be removed by an authorized Aroua Tek Inc. installer. If you unpack the product yourself and detect damage, to be entitled to a remedy, you must report said damage to Aroua Tek Inc. within 48 hours from the time of delivery. If your report is made in time, Aroua Tek Inc. will take into consideration the type of damage and may, at its sole discretion, take back and replace the damaged product or exchange it, or grant a discount.
  40. 3 If Aroua Tek Inc. determines that the home delivery service cannot be offered, Aroua Tek Inc. will designate a third party to deliver the Aroua Tek Inc. product to you under conditions similar to those of Aroua Tek Inc.’s home delivery service.
  41. Removal and Disposal of Used Devices
  42. 1 Upon request, Aroua Tek Inc. will remove a used device from the premises where the new product is delivered, provided that the used device is (i) unplugged and (ii) uninstalled. Although all precautions are taken, Aroua Tek Inc. will not assume any liability for damage caused by water, oil or other materials in connection with the removal of a used device. Aroua Tek Inc. reserves the right, at its sole discretion, not to remove any used device if it determines that there is a risk of damage or charges will be added in the event of removal of a device.
  43. 2 Provided that the used device can be removed without damage to your property and if you request it, Aroua Tek Inc. will dispose of the used device. This disposal will be subject to administrative and recycling fees, the rates of which will be determined by Aroua Tek Inc.
  44. Force Majeure
  45. 1 Aroua Tek Inc. assumes no liability under any circumstances for the failure or delay of a delivery resulting directly or indirectly from the following: natural disaster, war, threat of war, hostilities, civil commotion, laws, ordinances or government regulations, measures taken by government agencies, fire, explosion, accident, labor dispute, restrictions on trade or other, shortage or control of the supply of energy or raw materials, inability of Aroua Tek Inc. to purchase materials at commercially reasonable prices, failure of a supplier to meet its commitments to Aroua Tek Inc., failure or delay of transportation or other similar or dissimilar circumstances affecting Aroua Tek Inc. or an entity directly or indirectly related to the sale, manufacture or delivery of the products or product components (each of the aforementioned cases being hereinafter referred to as a “force majeure” event). Aroua Tek Inc. may, at its discretion and without obligation or prejudice, cancel or delay the delivery time in cases of force majeure. This provision will apply even if the force majeure event occurs after a first delay for one or more other causes. Notwithstanding the foregoing, you are not released from the obligation to pay when the time comes to settle the invoice.
  46. 2 In the event of a force majeure event, Aroua Tek Inc. may allocate its inventory of products for its own needs and those of its customers, without obligation to purchase the same products from other sources, including products that are not the subject of a contract, and this, based on what Aroua Tek Inc. considers reasonable. Except to the extent that there is cancellation of deliveries and allocations of inventory of products under this Agreement, this Policy remains unaffected.
  47. 3 If you are unable to accept a delivery due to a force majeure event, Aroua Tek Inc. may, at its discretion, cancel the delivery and the related agreement without any obligation to you or delay the delivery time initially scheduled for a period equivalent to the duration of the force majeure event.
  48. Aroua Tek Inc. Policy on customer service
  49. Accessibility for persons with disabilities in the context of its resale locations
  50. RIGHT TO ACCESSIBILITY
  51. The Accessibility for Persons with Disabilities Act of 2005 in Quebec and Ontario has set itself the goal of: achieving accessibility for persons with disabilities in relation to goods, services, facilities, housing, employment, buildings, structures and premises no later than January 1, 2025 for all commercial locations.
  52. This policy applies to Aroua Tek Inc. staff members. who deal with the public or other third parties as individuals involved in developing policies, procedures or practices relating to the provision of goods or services to the public or other third parties, whether acting as employees, volunteers, agents (service providers) or otherwise.
  53. POLICY STATEMENT
  54. In accordance with Ontario’s Accessibility Standards for Persons with Disabilities and Quebec’s Accessibility Standards for Customer Service, Aroua Tek Inc. is committed to providing an accessible and inclusive working and learning environment for all individuals who work at or visit Aroua Tek Inc. According to Aroua Tek Inc.’s policy, the workplace must be free from discrimination and harassment as defined in the Ontario and Quebec Human Rights Code.

  56. Provision of goods and provision of services to persons with disabilities:
  57. Aroua Tek Inc. will ensure that its policies, practices and procedures comply with the basic principles below, stipulated by the Accessibility for Ontarians with Disabilities Act of Quebec and Ontario.
  58. Dignity – Goods and services are provided in a manner that respects persons with disabilities and does not minimize their importance.
  59. Independence – Respecting people with disabilities means respecting their right to meet their own needs and to choose how they wish to receive goods and services.
  60. Integration – People with disabilities have access to all goods and services. This may require additional formats and flexible approaches. It means inclusion and full participation. It is a fundamental right.
  61. Equal Opportunity – Service is provided to people with disabilities in a way that gives them an equal opportunity to access goods and services.
  62. POLICY ELEMENTS
  63. Communication with People with Disabilities
  64. When communicating with a person with a disability, the business does so in a way that takes into account the person’s disability. Aroua Tek Inc. is committed to providing customer service training to all current and future employees and volunteers. This training will include, in particular, courses on how to interact and communicate with people with various types of disabilities.
  65. Notice of Planned or Unplanned Disruption of Services and Facilities at Aroua Tek Inc. Locations
  66. In the event of a planned or unplanned disruption in services and facilities for customers with disabilities (i.e. galleries, offices, distribution centers, special location or sales warehouse), Aroua Tek Inc. will notify the customer without delay. This prominently displayed notice will contain information regarding the reason for the disruption, its expected duration and a description of alternative facilities or services, if available.
  67. The notice will be placed on the front door of our gallery, distribution center, special location or sales warehouse. If the interruption is expected to last more than 48 hours, the notice will be posted on our website at www.arouatek.ca, under the tab “Visit Aroua Tek inc.” galleries and under the heading “Important announcements”.
  68. Assistive Devices
  69. Personal assistive technologies are permitted without restriction on Aroua Tek Inc. premises and will ensure that its staff are familiar with and able to use various assistive devices that may be used by customers with disabilities when accessing goods and services.
  70. Service Animals
  71. People with disabilities and service animals are welcome. Service animals are accepted in all areas of our premises that are open to the public. There may be rare circumstances where, for the health and safety of another person, consideration must be given to a person’s access to a particular area with their service animal. Examples of these circumstances include: (a) our professional showroom, where chemicals and equipment pose risks to other people and the service animal; (b) a person is allergic to animals and reacts negatively when approached by a service animal; (c) the gallery’s cooking workshop, as well as special areas where food is cooked and served.
  72. If a service animal is excluded due to such rare circumstances, Aroua Tek Inc. will find, within a reasonable time, a way or place that will allow the person with a disability to access the Company’s service.
  73. If it is not immediately apparent that an animal is a service animal, a representative of Aroua Tek Inc. may ask the person who presents with a service animal to provide elements to verify the animal’s function. It is important to specify that the use and safety of the assistance animal are part of the responsibilities incumbent on the person with a disability.
  74. Trusted Persons
  75. Visitors accompanied by a trusted person are welcome at Aroua Tek Inc. when the trusted person has been hired or chosen by the person with a disability to accompany them in order to help them access goods and services and to provide support in terms of mobility, personal assistance and communication.
  76. In the case of a culinary event sponsored by Aroua Tek Inc. in a gallery or in a particular location, the trusted person will not have to pay a fee if he or she wishes to participate in the event; however, the person registering for the event must declare that he or she will be accompanied by a trusted person at the time of registration. If a person with a disability fails to declare that he or she will be accompanied by a trusted person and arrives at the event with a trusted person, the trusted person will not be able to participate in the culinary event; he or she may, however, accompany the person with a disability in order to provide assistance during the event. This provision will be posted on our website under the “Institut culinaire Aroua Tek Inc.” tab, under the “Registration Requirements” heading.
  77. If you attend an event sponsored by a third party in an Aroua Tek Inc. gallery or in a particular location, the trusted person will not be able to participate in the culinary event. or in a particular location, an entrance fee may be required for the trusted person in accordance with the third-party provider’s registration standards.
  78. Feedback Process
  79. Feedback about the provision of services to individuals is welcome; this feedback can help us discover gaps and thus contribute to the continuous improvement of our services. Feedback can be made by email, or in person, or otherwise. Aroua Tek Inc. will make every effort to respond using the same means of communication.
  80. Feedback will be processed immediately whenever possible. However, some comments may take some time to process if they need to be reviewed before action is taken. Aroua Tek Inc. will respond to comments within 10 business days.

All required documents regarding accessibility standards for customer services, including the policy of Aroua Tek Inc. regarding accessibility to customer services, temporary interruption notices, training records and the written comment process are available upon request, subject to the Access to Information Act. information and privacy protection. When providing this information to a person with a disability, Aroua Tek Inc. will endeavour to provide a document or the information contained therein in a format that takes into account the person’s disability.
